Delivery

FroMagie undertakes to do everything possible to deliver the order as quickly as possible upon receipt of the order form. The delivery times indicated are only indicative and any delays do not entitle the buyer to cancel the sale, refuse the goods or claim damages.

FroMagie makes its best efforts to ensure that the products ordered are shipped within 10 working days, from the date of sending the order confirmation to the customer. This period - like the delivery guarantees mentioned in the conditions - are however of a purely indicative and non-contractual nature.

Parcels are sent by post exclusively in priority mode. To minimize transport time and keep products cool, shipments to Switzerland are made on the following days: Monday to Thursday (European Union and World: currently not available). Shipments may be suspended due to extreme weather conditions, such as heat waves.

The transport costs and risks inherent in the return of an unclaimed package (including in the event that the carrier does not leave a transit advice note) and / or a possible re-shipment are borne by the customer exclusively, as the risks inherent in the storage of the returned merchandise. Before any reshipment, FroMagie may ask the customer to pay the related costs.

Order process

Only clients who are of legal age, capable of discernment and who are not under guardianship can place an order via the website.

To place an order, the customer must follow the procedure available on the website. Any other ordering procedure is excluded.

By placing an order, the customer binds himself and declares that he has made a binding offer to FroMagie to purchase the selected goods under the conditions indicated on the website. The validity of the offer may be subject to maximum or minimum quantities. Formally, the customer submits his offer at the time his payment is approved. The sale is accepted - and therefore the contract is concluded - only from the moment FroMagie sends the order confirmation to the customer. FroMagie reserves the right to refuse an offer at its own discretion, without being obliged to state the reasons.

The data recorded by FroMagie constitute an irrefutable proof of the orders. The data recorded by the payment system constitute an irrefutable proof of the financial transactions.

The customer is solely responsible for the accuracy and completeness of the data he provides when registering on the website. If necessary, the customer shall communicate to FroMagie any modification of the data he has provided, by immediately updating his profile.

The customer must indicate a valid e-mail address to which all communications related to the order will be sent. It is the responsibility of the customer to keep this address up to date and to take note of the e-mails sent by FroMagie. 

The customer shall also configure - and regularly check - his "junk mail" box to make sure that no FroMagie e-mail is in it. Any communication made to the customer by e-mail will be considered as received by the latter on the date and at the effective time of reception, but at the latest 24 hours after its sending by FroMagie.

The customer chooses, when registering, or is given, in case of reset, a password allowing him to place an order or to use other functions of the site. This password is strictly confidential. It must not be disclosed to third parties under any circumstances. The customer is solely responsible for the use, conservation and security level of his/her password, which he/she can change at any time via the site. The customer is responsible for any order placed, even without his/her knowledge, using his/her password. If the customer knows or suspects that a third party has access to his/her password, he/she must notify us immediately.

Complaints

Any claim for non-conformity or missing article must be transmitted within 24 hours after the reception of the order. FroMagie is released from its delivery obligation in case of fortuitous events or force majeure.

Due to the perishable nature of the goods, no return is possible and therefore no refund of the transaction, which the customer expressly accepts. In case of a proven problem, the goods will simply be replaced.

Prices

FroMagie can change its prices at any time. Only the price indicated in the order confirmation is valid.

The preparation and delivery costs are those mentioned in the order confirmation.

The customer commits himself to pay the selling price in force at the time of the order entry. The payment of the order is payable immediately by credit card or direct debit. The payment methods accepted by FroMagie are exclusively those indicated on the website fromagie.ch

The payments are made by means of servers provided and secured by FroMagie's partner financial institutions, so that no financial information concerning the customer passes through our servers.

The risk of a malfunction of the payment system is borne by the customer, to the full discharge of FroMagie.
